In the Rajyashabha On August 8, 2019 (Monday), India witnessed an historic moment when the Home Minister from the BJP Party-Amit Shah- declared revocation of the Articles 370 and 35(A) anannouncing in Hindi which is as follows:


मैं संकल्प प्रस्तुत करता हूँ कि ये सदन 370 (3) के अंतर्गत भारत के राष्ट्रपति द्वारा जारी कि जानेवाली निम्नलिखित अधिसूचनाओं की सिफारिश करता है-

संविधान के अनुच्छेद 370(3) के अंतर्गत भारत के संविधान के अनुच्छेद के 370 खंड-1 के साथ पठित अनुच्छेद 370 के खंड-3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रपति संसद की सिफारिश पर यह घोषणा करते है कि यह दिनांक जिस दिन भारत के राष्ट्रपति द्वारा इस घोषणापत्र पर हस्ताक्षर किये जायेंगे और इसे सरकारी गजेट में प्रकाशित किया जायगा उस दिन से अनुच्छेद 370 (3) के सभी खंड लागु नहीं होंगे…’

With this declaration, the 72 years’ old highly debatable issue on Jammu and Kashmir was resolved. Barring few parties such as Indian National Congress, National Conference, TMC and PDP, all others supported the Government with great applause saying, ‘Now, in real sense, J&K is an integral part of India.’

The following major changes will occur in Jammu and Kashmir:

  1. J & K is now divided into two territories – J&K itself and Laddakh
  2. Both J&K and Laddakh are two new Indian territories to be solely governed by the Centre.
  3. Delimitations will be the basis of the conduction of the coming elections in the two newly formed Union Territories.
  4. Hoisting and unfurling other flag than the Indian Tri-colors will be considered breach of the Indian Constitution.
  5. J & K will have its own Assembly whereas Laddakh will lack.
  6. The J & K Assembly will last upto 5 years and then fresh elections will be held.
  7. People from all over India can purchase land in J&K.
  8. The Indian Constitution will be applicable in the two territories.
  9. Minorities will get 16% Reservation.
  10. Now, the Kashmiri Girl will not lose property and Jammu & Kashmir Citizenship in case she is married to a man belonging to other state.
  11. Panchayats will have the same rights as they have in other states of the country.
  12. Children will get benefited from Right to Education, which was not applicable before in the region.
  13. RTI (Right to Information) is now applicable in the two newly formed territories.
